Commercial and Real Estate Lending

Our commercial and real estate lending practice includes the representation of regional and national banks, institutional lenders, DUS lenders, and health care financing companies in the negotiation and documentation of a wide variety of loan and credit facilities. We have extensive experience in working with our various lending clients in the following types of credits:
  • Secured and unsecured working capital revolving credit facilities, letters of credit and equipment revolving credit facilities for middle market businesses;

  • Revolving credits and term loans for residential lot development and single and multi-family housing facilities;

  • Secured revolving credit and term construction loan facilities for development of commercial properties;

  • Short and long-term term loan and real estate financings;

  • Variable and fixed rate loan financings for assisted living and skilled nursing properties, including conduit loans;

  • Secured maritime financings involving the negotiation and preparation of commercial ship mortgages;

  • Participating mortgage secured loans with equity conversion options; and

  • Negotiation and preparation of participation agreements on behalf of both originating lenders and participating banks.
Our attorneys communicate extensively with our clients to understand the particular underwriting risks for a financing transaction, and to ensure that the loan documentation addresses the specific credit concerns for the particular transaction. Our attorneys are sensitive to the ongoing business relationship between our lending clients and our customers, and make a special effort to promote that relationship while at the same time protecting our lending clients' interests. Our commercial and real estate lending practice areas have had great success in staffing large multi-state secured financings with short closing schedules. Through our creditors' rights and bankruptcy practice group, we also provide service to our lending clients in workouts and bankruptcy proceedings.
