Biography

Matt Oakey is a member of Gallagher's Creditors' Rights and Bankruptcy group. He focuses primarily on the representation of lenders, banks and other financial institutions on creditors' rights, lender liability issues, and various workout matters. He is experienced in the enforcement of loan documents, collection on troubled loans and defense of borrowers' counterclaims. Matt also has experience representing lenders and tax-credit syndicators in commercial real estate transactions and in construction and rehabilitation financing of multi-residential projects through the use of tax-exempt bond financing and low-income housing tax credits. Matt advises clients in commercial and real estate litigation and risk management as well.

Representative Matters:

  • In re Honey Creek Kiwi, LLC, Case No. 03-2459, United States Bankruptcy Court for the Northern District of Texas. Represented national affordable housing lender in obtaining dismissal of a bankruptcy case filed by owner of a 656-unit affordable housing project in Dallas, Texas.


  • In re Van Leer, Case No. 99-62043, United States Bankruptcy Court for the District of Maryland. Represented a secured lender in Chapter 11 bankruptcy of landfill developer. Following several contested hearings and appeals, successfully negotiated long-term cash collateral order to provide for full payment of debt to client.


  • In re U.S. Gen New England, Inc., Case No. 03-30465, United States Bankruptcy Court for the District of Maryland. Represented the City of Salem, Massachusetts and seven towns in New Hampshire and Vermont in the Chapter 11 bankruptcy of an energy company. Successfully protected the municipalities’ interest in preserving tax revenue and real estate transfer taxes derived from hydro-electric projects owned and operated by the debtor.


  • Fort Washington Care Center L.P. v. Fort Washington Nursing Home, Inc., Case No. 00-10014, United States Bankruptcy Court for the District of Columbia. Represented the landlord of a long term care nursing facility in the Chapter 11 bankruptcy of the facility operator. Prevailed in defeating a preliminary injunction, which enabled the client to enter into a favorable sale transaction.


  • Bereson v. Cindarn Corporation, et al., Case No. 93CV11495, Circuit Court of Maryland for Baltimore County. Represented seller of business in suit against buyers for nonpayment of purchase price. Successfully obtained judgment against defendants for full amount sought in complaint and also defeated defendants' counterclaim. In addition, obtained an award of sanctions of $125,000 against opposing counsel and successfully collected the $125,000 award.


  • Maryland Bank & Trust Co., N.A. v. Mason et al., Case No. 08-C-04-570, Circuit Court of Maryland for Charles County. Represented a bank in a successful action to enforce multiple personal guaranty agreements securing a $1.8 million loan to a surgical practice in Charles County, Maryland.


  • Sparks State Bank v. Timonium Chrysler-Plymouth, Inc., Circuit Court of Maryland for Baltimore County. Represented a bank in a complex fraud action, resulting in a major settlement.


  • In re The Art Works Corporation, Case No. 97-53573-SD, United States Bankruptcy Court for the District of Maryland. Represented secured lender in disputes with bankruptcy trustee regarding payment of its claim. Successfully obtained full payment of client's claim.
