Biography
Brian is a litigator who focuses on complex commercial disputes and matters involving primarily educational and nonprofit organizations. He has obtained judgments in favor of primary and secondary schools, colleges and universities, and health care and religious entities in an array of discrimination, tort and contract cases. In addition to litigation, Brian advises clients on compliance and sensitive risk management issues and conducts investigations of fraud and misconduct.
Brian served a judicial clerkship with the Honorable Richard D. Bennett of the United States District Court for the District of Maryland. Prior to entering the practice of law, he was a Senior Research Program Coordinator at the Johns Hopkins University School of Medicine's Lupus Center.
Representative Matters
- Prevailed in trial court and on appeal for a college faculty member in a breach of contract, Lanham Act, and defamation lawsuit involving medical research.
- Represented a religious organization in a two-week federal jury trial, post-trial motions, and appeal that resulted in a $3.7 million jury verdict and injunctive relief on claims under the Equal Protection Clause of the U.S. Constitution and the Religious Land Use and Institutionalized Persons Act (RLUIPA).
- Obtained summary judgment on behalf of a college in a case involving allegations of ADA violations and breach of contract by a dismissed graduate student.
- Prevailed in trial court and on appeal for a religious entity against claims of breach of contract and specific performance related to the sale of commercial real estate.
- Obtained summary judgment in a defamation claim brought against a college and its officers by a former employee.
- Prevailed in trial court and on appeal for a religious entity against claims of breach of fiduciary duty and negligent hiring, retention and supervision.
